The article seems to imply ('single seat') that this new legislation will only apply to a scooter that is built for the use of a sole person, so I assume that tandem (mobility) scooters are already covered elsewhere in Spanish law?
The maximum speeds mentioned in the article would also suggest that this legislation includes children's e-scooters.
Not quite sure where this leaves the PAYG/App connected e-scooter hires on the coast. This new legislation is for 'private scooter owners', so would not apply to scooter hire. A quick look at one of the e-scooter operators on the coast and it says the hiree is liable for any damage, yet there does not seem to be any mechanism to ensure that the hiree has insurance prior to riding off on an e-scooter they have found in the street.

I would have thought that there is a mandatory Third-Party Liability insurance (as in any other business) to cover damage to other parties, hence stating that damage to the rental scooter is payable by the hirer.
