Parks, Gardens and... Treasury

In the department to which the appellant is attached, as clarified by the municipal resolution, he is assigned the maintenance and surveillance of public green areas, as well as auxiliary tasks related to public works and services. The petitioner's main argument is surprising and weighty: he is currently working in the Treasury area. Neither the applicant himself, nor the City Council, which recognizes this temporary destination, clarify how the green team laborer exercises his functions in the Treasury area, where effectively, most of his colleagues have joined the teleworking.

He has also seen requests from this type of personnel who work essentially in front of the public rejected.

Regulation

The Torrevieja City Council approved its own rules of procedure on teleworking at the end of 2023. Like so many other municipalities in Spain, it formalized and brought order to the experience to which the different administrations were forced to maintain their daily activity despite the covid restrictions. And it accelerated the guarantee of a modality of work requested in the administration -and in companies-, for many years before.

Among other limitations on the exercise of the right to telework, it is established that it is always a voluntary, reversible, authorized and compatible mixed modality with face-to-face work, restricted to two days a week and that it can be carried out remotely by telematic means. Also that the day before or after a teleworking day can only be a face-to-face day, weekend or holiday. That is, discontinuous in the weekly distribution. Although the regulations recommend that the requests do not accumulate on Fridays and Mondays, the result in the Torrevieja City Council is that no worker asks to telework on Tuesdays and Thursdays, which could be. And practically none of them do without Monday or Friday.
