Does sort of lead onto a question if you are employed (not self-employed) and your company lets you work from home, your home becomes the workplace, does your employer become liable if you should have an accident at home during your working hours ?
The Law Is An Ass
The Law Is An Ass
Common sense seems to be leaving this World at the moment.

Re: The Law Is An Ass
Good question, and I can't understand the judges logic that " Had the employee not been working at the time, the accident would not have taken place".
It's sounds blindingly obvious, but yes the same logic must apply if you are working from home.
I wonder when someone will test it.

If you are working from home should that be declared on you home insurance policy (uk asks that question).
I wonder how many if any do and ring up the company to advise them of the change.
Re: The Law Is An Ass
So my question about home becoming workplaces and employer liability for accidents during working hours at home has been answered, subject to any potential appeals to overturn the verdict.

This just opens a can of worms for home working in Spain - employer insurance, workplace supervision, health and safety, risk assessment etc.

A lack of common sense is an international phenomenon. Instead of clarity it seems the judiciary are busy clouding issues and creating more grey areas.Carl wrote: 04 Apr 2023 19:58 So my question about home becoming workplaces and employer liability for accidents during working hours at home has been answered, subject to any potential appeals to overturn the verdict.
